In consideration of being allowed to enter the play area, use the equipment or to participate in any party and/or program at creative kidz play place llc Inc.The undersigned, on his or her behalf, and on behalf of the minor(s) identified below, acknowledges, appreciates, agrees and is fully aware of the risks and hazards in participating in any of the activities on the premises of creative kidz play place llc. and further agrees as follows:
I agree for myself and/or the minor(s) listed below that we shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as conditions for play and participation in any party and/or program and creative kidz play place llc. and agree to pay for all damages to the facilities of creative kidz play place llc. caused by myself or the listed minors’ negligent, reckless, or willful actions. In addition, if I observe any hazard during our participation, I will bring it to the attention of the nearest creative kidz play place llc. employee or official immediately. I recognize and understand that there are certain inherent risks associated with use of the play area, parties, and programs and that risks of injury include, without limitation, scrapes, bruises, cuts, and even more serious injuries, such as paralysis or death. Moreover, for myself and the minor(s) named below, I fully accept and agree to assume all of these risks (including risks arising from the negligence of other participants), and I assume full responsibility for personal injury to myself and the listed minor(s) and our respective heirs, assigns, administrators, personal representatives, and next of kin, completely and forever waive, release, and hold harmless, creative kidz play place llc., its officers, members, agents, employees, other participants, and sponsoring entities for injury, loss, or damage arising out of or related to our participation in any and all creative kidz play place llc. programs, activities, parties, and/or the use of any of the facilities of creative kidz play place llc This waiver and release shall be binding and apply to all risks, known and unknown, even if resulting from negligent actions of other guests or employees of creative kidz play place llc..
Each participant must sign this waiver form, either by them or if you are under the age of 18 years, then signed by a parent/legal guardian or designated representative by parent/legal guardian. If a waiver is not signed, the person will not be able to participate in creative kidz play place llc., parties, and/or use of the play area and equipment.
Parents/legal guardians/designated representatives by parent/legal guardians must supervise their minor(s) at all times.
MEDIA RELEASE
I hereby grant permission to creative kidz play place llc. to use photographs and videos of me and the minor(s) written below taken at creative kidz play place llc., in any social media publications. I do not grant creative kidz play place llc. to resale or use the photographs and videos in a manner that would exploit or cause malicious representation toward me and my minors listed below.
COVID-19 ADDENDUM
The World Health Organization has declared the novel Coronavirus (COVID-19) not a worldwide pandemic since May, 2023. However, due to its capacity to transmit from person-to-person through respiratory droplets, the government has set recommendations, guidelines, and some prohibitions which creative kidz play place llc. adheres to comply with.
In consideration of my participation in the foregoing, the undersigned acknowledge and agree to the following:
I am fully and personally responsible for my own safety and actions while and during my participation and I recognize that I may in any case be at risk of contracting COVID-19.
With full knowledge of the risks involved, I hereby release, waive, discharge creative kidz play place llc., its board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.
I agree to indemnify, defend, and hold harmless creative kidz play place llc. from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.
I am aware of the existence of the risk of my physical appearance to the venue and my participation to the activity of creative kidz play place llc. that may cause injury or illness such as, but not limited to Influenza, MRSA, or COVID-19 that may lead to paralysis or death.
I have not experienced symptoms of fever, fatigue, difficulty in breathing, or dry cough or exhibiting any other symptoms relating to COVID-19 or any communicable disease within the last 14 days.
I represent that I am the parent or legal guardian of the minor(s) named below, or I have obtained permission from the parent/legal guardian of the minor(s) named below to execute this agreement on their behalf. I further represent that the participants are healthy and physically able to participate in any and all undertaken activities.
Any controversy, disputes or claim arising out of related to this agreement, which the parties are unable to resolve by mutual agreement shall be settled exclusively by submission by either party of controversy, claim or dispute to binding arbitration; said arbitration to take place exclusively before a single arbitrator located within 30 miles of the play studio / play space and in accordance with the rules the American arbitration association then in effect
